Patients with either hereditary or acquired thrombophilia can present with arterial and venous thrombotic complications. However, it is unclear to whom the thrombophilia panel should be assessed, particularly in patients presenting with a common cardiovascular risk factor and acute coronary thrombus. Herein, we presented the management of an active smoker female patient who presented to our emergency room with inferior acute ST-segment elevation myocardial infarction, and hereditary thrombophilia has been diagnosed due to the presence of substantial left main coronary artery (...) thrombus. Coronary artery vasospasm (CAVS) is a clinical entity that can cause angina, but also unstable angina pectoris, acute myocardial infarction, fatal arrhythmias, and sudden death. Although it is a condition that is usually controlled with medical treatment, more aggressive treatments may rarely be required. In this case, the patient with a known diagnosis of CAVS had multiple arrests despite optimal medical treatment. We observed that fatal arrhythmias persisted in the Implantable Cardioverter Defibrillator (ICD) records, even though we implanted a stent (...) and gave the patient maximal medical treatment. We performed sympathectomy as a last resort and we did not detect any recurrence in the 6-month follow-up of the patient. ICD implantation and sympathectomy should always be considered in resistant CAVS cases. (shrink)

Flew strongly defends a compatibilist thesis in the free will debate before going on to totally object to theistic libertarianism. His objections basically rely on his compatibilism embracing the notion of agent causation, which is not very common in compatibilist theses. Since he is a strong proponent of ordinary language philosophy, he also holds that linguistic analyses can certainly solve the free will problem as well as many other problems of philosophy. In doing so, he first uses the paradigm cases (...) based on our common sense experience and then assumes the verity of principle of alternative possibilities. This study attempts to show, on the one hand, that there are some serious difficulties in both his justification of compatibilism and his objections to theistic libertarianism, and on the other hand, that he cannot easily defend both at the same time. A salient tradition in contemporary affect theory heavily relies on distinguishing between emotions and affects. The former refers to structured categories of socially coded affective states, while the latter denotes the pre-social libidinal flow underlying emotions. This distinction is commonly attributed to Spinoza and is thought to have been further developed by Deleuze. In this article, I argue that this overall historical picture is misleading and inaccurate. Deleuze radically transforms Spinoza’s theory of affect for the ends of his own ethical-political (...) philosophy. Moreover, I argue that Deleuzian and similar conceptualizations of affect fail to fulfill their political and ethical promises due to two critical problems. In the last section, I show that a unified notion of emotion inspired by Spinoza, which does not create a sharp rift between emotions and affect, can perform the same explanatory function intended by the emotion-affect distinction while allowing us to circumvent these problems. The problem of determinism and human freedom, which is one of the great debates in philosophy, has been discussed many times by philosophers who have very distinctive perspectives and thereby different results related to the problem. Charles Hartshorne as an American process philosopher has significantly contributed to the debate with his own thoughts and considerations. His thoughts can be divided into two major parts. First is the claim that there is a relative indeterminism within the universe. Second is that (hard) (...) determinist and compatibilist positions have serious theoretical and practical difficulties. This paper is only about second part of his thoughts related to the debate. So, in this paper, firstly, I attempt to depict and examine his objections to the arguments for determinism and compatibilism. And then, secondly, I try to interrogate two fundamental assumptions behind his objections. One is the fallacy of burden of proof and other is a fallacy based on the appeal to common sense in order to prove any factual or metaphysical assertion. (shrink)

Objective: Kindling is an animal model of epilepsy induced by electrical stimulation of the brain. The present study aimed to present a different perspective with a bibliometric approach by using the literature data on the “Kindling model” related keywords in the Web of Science (WoS) online database between 1980 and 2023. -/- Methods: The bibliometric data were obtained from the online database WoS and analyzed and visualized with the VoS Viewer Program. The bibliometric datasets were analyzed and visualized regarding article (...) productivity numbers according to years, article productivity numbers according to countries, the most used keywords according to authors, and cross-country cooperation. -/- Result: Considering the results of the analysis of the published datasets, 2022 was determined as the year with the highest article productivity, and an acceleration was observed in the publication increase rate on the subject in general. When the order of the countries in the top three in the number of article productivity was examined, the USA, Germany, and Japan are the main countries, respectively. The most used keywords by the authors were determined as “Epilepsy”, “Kindling”, and “Hippocampus”. In the cooperation among countries, it was found that the USA, Germany, and Japan had more cooperation with other countries, respectively. -/- Conclusıon: This study will contribute to the literature by providing a detailed understanding of the research basis, relevant research results, current research boundaries and main research focus in the Kindling Model. How can we understand the phenomena of loss and mourning in the Heideggerian framework? There is no established interpretation of Heidegger that gives an elaborate account of the phenomena of loss and mourning, let alone gauges its importance for our understanding and assessment of authentic existence in Heidegger. This paper attempts to do both. First, I give a detailed exposition of Heidegger’s analysis of the phenomena of mourning and loss and show that Heidegger’s analysis of mourning in his early and (...) late work is strikingly in line with his collectivist understanding of Being-with. This demonstrates, contrary to what some of his proponents argue, that Heidegger does not follow the kind of dynamic understanding of Being-with that places the other within fine-grained spaces of possibility. Second, with reference to Heidegger’s existential philosophy, I construct a phenomenology of mourning and grief. Though Heidegger himself fails to explain the relationships in which one mourns after a close other, we can develop a unique phenomenology of mourning with reference to Heidegger, which shows that each loss is singular and can be equiprimordial with one’s own death in opening one to the possibility of an authentic existence. In this new understanding of authenticity, loss is regarded as a powerful force, akin to death, in leading one toward their self-owned existence. (shrink)

Affects are intentional structures of beliefs and desires. Many philosophers have plausibly argued that Spinoza’s theory of ideas is a kind of theory of belief. Yet this claim has rarely been taken into account when it comes to Spinoza’s theory of affects, which is actually a part of his theory of ideas. This paper shows that if this point is taken seriously when regarding Spinoza’s theory of affects we reach significant results about the fifth part of Ethics. To show this, (...) I shall strive to show that all affects depend on some sort of beliefs by analyzing Spinoza’s theory of affects in terms of his theory of ideas, and in particular an affirmation which an idea naturally involves. From this revelation, we will be able to see that Spinoza’s theory of affects presented in the third and fourth parts of Ethics is inconsistent with the fifth part of Ethics in so far as the three therapy methods he describes at the beginning of the fifth part of Ethics are considered. I will also show that arguments by which the soundness of these therapy methods is guaranteed seem actually logically invalid. Finally, I will try to revise Spinoza’s therapy methods by taking all errors and core ideas in Spinoza’s theory of affects into consideration. (shrink)

Söz konusu çalışmada, şematizmin temsiller arasındaki geçişlerle nasıl anlaşılabileceği; duyusallık ile anlama yetisi ve anlama yetisi ile akıl arasındaki ilişkiyi nasıl oluşturduğu gösterilecektir. Bu ilişki, anlama yetisinin duyusallıktan gelen malzemeyi nasıl kurduğu, aklın ise anlama yetisinden gelen bilgileri nasıl düzenlediğiyle ilgilidir. Göreceğiz ki şematizm, matematiği ve fizyolojiyi (fizik ve metafizik) zamansallığa dayanarak temellendirir. -/- This thesis deals with the act that Kant calls schematism, the way of applying intellectual concepts to sensible appearances. Schematism has been generally criticized or deemed incomprehensible by thinkers, but it constitutes a vitally important aspect of the critical philosophy. In this study, I will attempt to show how schematism provides transitions between representations and establishes the relation between sensibility and understanding, also between understanding and reason. The relation is about how the understanding constructs the material of sensibility, and how the reason regulates the cognitions of the understanding. In this respect, I will also show that possible transitions between representations (discursive, determinative, reflexive and analogical) enable different ways of schematism. It will be shown that schematism grounds mathematics, and physiology (physics and metaphysics) based on temporality. (shrink)

It is now widely accepted that astronomical factors trigger the emergence of glacial and interglacial periods. However, nearly two centuries ago, the overall situation was not as apparent as it is today. In this article, I briefly discuss the astronomical model of ice ages put forward in the 19th and early 20th centuries. This period was indeed anni mirabiles for scientists to understand the ice age phenomenon. Agassiz, Adhémar and Croll laid the foundation stones for understanding the dynamics of ice (...) ages. But it was Milankovitch who combined empirical geology with mathematical astronomy. Specifically, he identified the shortcomings of the preceding ice age models and modified his model accordingly. In what follows, I review earlier approaches to the ice age problem and show how they failed to meet their objectives. Next, I show how Milankovitch's model managed to capture all sufficient astronomical elements. The final sections focus on Milutin Milankovitch's successful approach, including his accomplishment of tackling the problem mathematically. (shrink)

Interaction between drivers and pedestrians is often facilitated by informal communicative cues, like hand gestures, facial expressions, and eye contact. In the near future, however, when semi- and fully autonomous vehicles are introduced into the traffic system, drivers will gradually assume the role of mere passengers, who are casually engaged in non-driving-related activities and, therefore, unavailable to participate in traffic interaction. In this novel traffic environment, advanced communication interfaces will need to be developed that inform pedestrians of the current state (...) and future behavior of an autonomous vehicle, in order to maximize safety and efficiency for all road users. The aim of the present review is to provide a comprehensive account of empirical work in the field of external human–machine interfaces for autonomous vehicle-to- pedestrian communication. In the great majority of covered studies, participants clearly benefited from the presence of a communication interface when interacting with an autonomous vehicle. Dear Colleagues, -/- The statement made by Journal Citation Reports on 26 July 2022, it was reported that some important updates in the journal metrics will be published in 2023 [1]. The most striking of these changes was that the journal impact factor would now be calculated, including journals from the Arts and Humanities Citation Index (AHCI) and the Emerging Sources Citation Index (ESCI). -/- On 28 June 2023, the current metrics of the journals indexed in the Web of Science (...) were shared by the Journal Citation Reports for 2022 [2]. As it is known, the European Journal of Therapeutics is indexed in the ESCI and is included in the Category of Medicine, General & Internal. Therefore, the impact factor was calculated for the European Journal of Therapeutics for the first time. -/- According to the report recently announced by Journal Citation Reports, the impact factor of the European Journal of Therapeutics for 2022 is 0.3 (Fig. 1) [3]. In addition, the European Journal of Therapeutics ranks ninetieth among one hundred fifty-seven (90/157) in the Category of Medicine, General & Internal, and ESCI-indexed journals [4]. -/- Although the first impact factor declared for the European Journal of Therapeutics is 0.3 is not a bad value, it is an inevitable reality that it should be better. On the other hand, in previous editorials [5, 6], it was reported that the articles accepted in the European Journal of Therapeutics were now published as Accepted / Early Views Articles quickly [6]. In addition, it was stated that the editorial team was enriched with many internationally important academicians in their fields [5]. Bilim felsefesinin en temel problemlerinden biri olan sınırlandırma problemi belirli bir ölçüt vasıtası ile bilimi, bilimsel olmayan ya da sahte/sözde bilim olan etkinliklerden ayırt edip edemeyeceğimizi konu edinmektedir. Literatüre baktığımızda felsefeciler –özellikle bilim felsefecileri– bilimin doğasını karakterize etme girişiminde bulunurken bilim dilinin mantıksal yapısına ya da bilimin tarihsel süreçlerine odaklanarak, bilimi bilimsel olmayan ya da sahte-bilim olan etkinliklerden ayırt etmişlerdir. Bu çalışma ise farklı bir yaklaşım benimseyerek sınırlandırma problemine, felsefecilerin değil, bilim insanlarının perspektifi ile bakmayı amaçlamaktadır. Bu sebeple alanında deneyimli (...) ve çeşitli bilim dallarında profesör olan otuz bilim insanı ile niteliksel araştırma yöntemlerinden biri olan yapılandırılmış görüşme tekniği uygulanmıştır. Bu görüşmeler aracılığıyla bilim insanlarının sınırlandırma problemi hususunda öne sürdükleri görüşler açığa çıkartılıp değerlendirilmiştir. Değerlendirme neticesinde üç temel bulguya ulaşılmıştır. İlki, sınırlandırma problemine ilişkin sorularımıza bilim insanları tarafından getirilen yanıtların birçoğu temel felsefi yaklaşımlarla uyuşmaktadır. Elde ettiğimiz verileri farklı temalar altında analiz ettiğimiz bu çalışmada, sınırlandırma problemine dair yaygın felsefi görüşlerin, bilim insanlarının görüşleri ile anlamlı benzerlikler taşıdığı kısımlar vurgulanmıştır. İkincisi, sınırlandırma problemi ve bu problemlerle ilişkili diğer meseleler üzerinde felsefi olarak sağlanamayan uzlaşma, bilim insanları arasında da mevcuttur. Ne var ki bu ihtilaf dengeli bir biçimdedir, öyle ki benzer yanıtlara sahip olan bilim insanları baskın bir grup sayısına ulaşmamıştır. Üçüncü ve son olarak, bilim insanlarının bilim felsefesinin temel problemlerine yüksek oranda yabancı olduğu görülmektedir. Bu bulgu, her ne kadar nicel olmayan bir yolla ölçülmüşse de verilerin dikkatli analizi durumun bu yönde olduğunu göstermektedir. Zihin–beden problemi felsefenin en köklü ve temel problemlerinden biridir. Köklü geçmişine rağmen probleme getirilen yanıtlar hususunda felsefe literatüründe bütünüyle bir uzlaşımın olmadığını söylemek ise pekâlâ mümkündür. Zihin–beden problemi en basit haliyle şöyle ifade edilebilir: Birbirinden her özelliği ile ayrılan zihin ve beden birbirlerini etkiler mi ve eğer etkiler ise bu etkileşim nasıl olmaktadır? Neredeyse her felsefi mesele gibi, zihin–beden probleminin geçmişi de Antik Grek felsefesine kadar götürülebilir. Ancak söz konusu problem ile ilgili yapılmış detaylı çalışmalar ilk olarak rasyonalist filozoflar tarafından (...) yapılmıştır ve daha sonra empirist felsefeye doğru genişlemiştir. Bu yazıda ilk kesim filozofların, yani rasyonalistlerin, problemi ortaya koyuş biçimleri ve söz konusu probleme getirmiş oldukları yaklaşımlar incelenecektir. Bunu yaparken dört temel rasyonalist filozofun argümanları analiz edilecektir. Daha detaylı bir ifadeyle, bu yazının konusu Descartes’ın, Malebranche’ın, Spinoza’nın ve Leibniz’in zihin–beden problemine sunmuş oldukları çözüm önerilerini incelemek olacaktır. Son kısımda ele almış olduğum dört filozofun felsefi pozisyonlarındaki farklılıklara kısaca değinilecek, zihin–beden probleminin çeşitli implikasyonları ele alınıp güncel felsefedeki problemler ile bağlantısı gösterilecektir. Düşünce deneylerinden beklenen şeylerden biri de mevcut bilgimizi test etmesi ya da bilgimizi artırmasıdır. Ancak adından da kolayca anlaşılacağı gibi, yalnızca düşüncede yürütülen böyle bir deney, örneğin bize ne şekilde yeni bir bilgi sağlayabilir? Bu zamana kadar söz konusu soruya, bilim felsefesi literatüründe, başlıca beş temel yanıt verilmiştir. Bu makalede, tüm bu yaklaşımların -Platoncu yaklaşım hariç- ortak bir varsayımını ele alacağım. Bu varsayıma göre düşünce deneylerinin tüm yönlerini açıklayabilecek kapsayıcı bir teori bulunmaktadır. Düşünce deneylerinin doğasına ilişkin bu tekçi varsayım, en (...) azından iki yönden oldukça sorunlu görünmektedir. İlk olarak, belirli bir düşünce deneyinin tek bir yaklaşımla açıklanamayan yönleri bulunmaktadır. İkincisi, şimdiye kadar önerilen yaklaşımlar tüm düşünce deneylerini açıklayamamaktadır. Bu iddiaları temellendirmek ve bahsedilen yaklaşımların eksikliklerini belirtmek için Galileo’nun ve Darwin’in öne sürdüğü düşünce deneyi örneklerini ele alacağım. Son olarak çoğulcu bir yaklaşımın düşünce deneylerinin doğasını açıklamada çok daha uygun bir çerçeve sağladığını öne süreceğim. (shrink)

Objective: Primary care, which is often the first level of contact for patients with various communicable diseases (CDs) and noncommunicable diseases (NCDs), might exhibit patterns of injectable drug utilization different from hospitals. We aimed to examine injection prescribing to adults with CD or NCD in primary care. -/- Methods: In this retrospective study, single-diagnosis injectable drug-containing prescription data from Family Medicine Information System comprising 32 provinces of Turkey were analysed. The prescriptions were grouped by diagnosis as “CD” (n=3848) and “NCD” (...) (n=9338). Injectable drug utilization patterns in these groups were analysed by demographics, diagnoses, and drug subgroups. -/- Results: Out of 13186 prescriptions, 70.8% were issued for NCDs. NCD prescriptions were mostly generated for women and elderly (p<0.05 for both). About 63.3% (n=2948) of injectable drugs in CD prescriptions were antibiotics and 12.6% were analgesics. Cefazolin (15.2%) was the most commonly prescribed antibiotic for acute pharyngitis and acute sinusitis, and benzathine benzylpenicillin (12.8%) was the top-choice for acute tonsillitis and rheumatic fever. In NCD prescriptions, 34.0% (n=4214) of injectable agents were analgesics and 16.9% were muscle relaxants. The most frequently encountered drug in NCD prescriptions was thiocolchicoside (16.3%), which was the top-choice in all seven common musculoskeletal diagnoses. -/- Conclusion: Muscle relaxants and analgesics were the most commonly prescribed injectable drugs for NCDs, musculoskeletal diseases in particular. Antibiotics were frequently encountered in CD prescriptions, mostly as broad-spectrum for lower respiratory tract infections (RTIs) and narrow-spectrum for upper RTIs. Objective: The nutrient artery which enters through the nutrient foramen (NF) provides blood circulation and nutrition in long bones. This supply is essential during the growing period, the early phases of ossification, and in some surgical procedures. This study aimed to investigate NF in adult human ulnas in the Turkish population. -/- Methods: For this study, 155 (70 right and 85 left) Turkish dry adult human ulnas were used. The presence, number, and patency of NF were recorded as well as (...) its topography and direction. The vertical distance between the most proximal point of the olecranon and the proximal edge of the NF (DONF), and the longitudinal distance between the most ventral point of the coronoid process on the sagittal plane and the proximal edge of the NF (DCpNF) was calculated. Additionally, the foraminal index (FI) was assessed. -/- Results: Single and double NFs were in 139 ulnas (89.67%), and 3 ulnas (1.94%), respectively. NFs were not observed in 13 ulnas (8.39%). The majority of NFs (93.12%) were situated on the anterior surface of the ulna. The direction of all NFs was towards the elbow. The mean DONF and DCpNF were 9.48 ± 1.57 cm, and 6.68 ± 1.44 cm, respectively. The FI was 37.45% in ulnas with a single NF, while it was 41.46% in ulnas with a double NF. -/- Conclusion: Our study has presented additional information such as the FI of ulnas with 2 NFs, and the distance between the coronoid process and NF in the Turkish population. Objectives: Inferior oblique muscle overaction (IOOA) is a common ocular motility disorder. Ocular Vestibular Evoked Myogenic Potentials (oVEMP) are tests that evaluate the reflex pathway between the utricular macula and the inferior oblique muscle to detect vestibular diseases. Our study is of great importance as it is the first study in the literature to evaluate the effect of inferior oblique muscle overaction on oVEMP parameters. -/- Methods: Thirty-five patients with unilateral inferior oblique muscle overaction (IOOA group) and 18 healthy volunteers (...) without any neurological or vestibulocochlear disease were included in this study. All patients and healthy volunteers were evaluated with oVEMP. -/- Results: No statistically significant difference was found between the n1 latency, p1 latency, n1-p1 latency measurement values of the participants included in the study (p>0,05). A statistically significant difference was found between the n1-p1 amplitude measurement values of the participants in patient groups (non-squint eyes, squint eyes) and control groups (p-value was 0.038). -/- Conclusion: In IOOA patients, vestibulo-ocular reflex pathway may be affected, vestibular symptoms may develop thus o-VEMP responses may be affected. A careful anamnesis should be taken in IOOA patients, and it should be kept in mind that n1-p1 amplitudes and asymmetries may be significantly higher when o-VEMP is performed. (shrink)

Objective: The use of neoadjuvant chemotherapy (NACT) in breast cancer is increasing. The management of locally advanced breast cancer differs due to the approach of the center to which the patient applied and the approach of the following physician. From this point of view, we aimed to evaluate the real life data of our region. -/- Methods: The study included 106 patients treated with neoadjuvant chemotherapy in the medical oncology clinic of two different university hospitals. Association between clinicopathological features and (...) pathological complete response (pCR) were analyzed. -/- Results: The pCR rate was higher in patients with negative hormone receptors and this difference was statistically significant (p:0.000). The rate of obtaining pCR increased as the NACT duration increased, and this increase was statistically significant. The mean NACT duration applied to the patients with pCR was 5.48 ± 0.22 months, and the mean NACT duration for those who could not obtain pCR was 5.01 ± 0.1 months (p:0.041). The recurrence rate of patients with pCR was 11.1%, while the recurrence rate of patients who could not obtain pCR was 31.6% (p:0.04). -/- Conclusions: Pathological response to chemotherapy is an important factor in determining prognosis. There appears to be a need for new biomarkers that allow the prediction of pCR and long-term outcomes. (shrink)

Background -/- Retraction is a correction process for the scientific literature that acts as a barrier to the dissemination of articles that have serious faults or misleading data. The purpose of this study was to investigate the characteristics of retracted papers from Kazakhstan. Methods -/- Utilizing data from Retraction Watch, this cross-sectional descriptive analysis documented all retracted papers from Kazakhstan without regard to publication dates. The following data were recorded: publication title, DOI number, number of authors, publication date, retraction date, (...) source, publication type, subject category of publication, collaborating country, and retraction reason. Source index status, Scopus citation value, and Altmetric Attention Score were obtained. Results -/- Following the search, a total of 92 retracted papers were discovered. One duplicate article was excluded, leaving 91 publications for analysis. Most articles were retracted in 2022 (n = 22) and 2018 (n = 19). Among the identified publications, 49 (53.9%) were research articles, 39 (42.9%) were conference papers, 2 (2.2%) were review articles, and 1 (1.1%) was a book chapter. Russia (n = 24) and China (n = 5) were the most collaborative countries in the retracted publications. Fake-biased peer review (n = 38), plagiarism (n = 25), and duplication (n = 14) were the leading causes of retraction. Conclusion -/- The vast majority of the publications were research articles and conference papers. Russia was the leading collaborative country. The most prominent retraction reasons were fake-biased peer review, plagiarism, and duplication. Efforts to raise researchers’ understanding of the grounds for retraction and ethical research techniques are required in Kazakhstan. (shrink)

Além de conter o relativismo, também contém o antropocentrismo. Ou seja, podemos dizer que o fogo queima, isso não é relativo, assim como a água molha e sacia a sede, bem como se não nos alimentarmos morreremos. Tais fatos não são relativos. Mas quando dizemos sobre sensações místicas, mágicas, percepções, noções e concepções ‘espirituais,’ ‘religiosas’ e com ‘deuses ou divindades,’ elas não são fatos absolutos em si, mas evidências relativas, pois cada pessoa vê, sente, percebe e reproduz sensações místicas de forma bem particular, pessoal e específica. Isso também em relação as manifestações religiosas e seus deuses. Já que são produtos culturais, sociais e de subjetividades. \ . -/- O trabalho em tela é um esforço de expor e contextualizar, as possíveis expressões das primeiras formas, modos e tipos de manifestações místicas, ritualísticas, mágicas, sacrificiais, de crenças e míticas nos processos sociais, culturais, econômicos, políticos e históricos das sociedades. Verificando assim, os primeiros fundamentos, processos e construções biopsicossociais, bem como suas produções e reproduções místicas e de crenças. Isso sendo verificado através e por meio dos povos considerados primitivos, antigos e arcaicos. Entretanto, após a criação das religiões e suas relações com o Estado, sobretudo com o sistema capitalista, tais dissonâncias são bem mais evidentes. Various approaches have emerged over the last several decades to meet the challenges and complexities of anticipating and responding to the potential impacts of emerging technologies. Although many of the existing approaches share similarities, they each have shortfalls. This paper takes as the object of its study Anticipatory Ethics for Emerging Technologies (ATE) to technology assessment, given that it was formatted to address many of the privations characterising parallel approaches. The ATE approach, also in practice, presents certain areas for retooling, (...) such as how it characterises levels and objects of analysis. This paper results from the work done with the TechEthos Horizon 2020 project in evaluating the ethical, legal, and social impacts of climate engineering, digital extended reality, and neurotechnologies. To meet the challenges these technology families present, this paper aims to enhance the ATE framework to encompass the variety of human processes and material forms, functions, and applications that comprise the socio-technical systems in which these technologies are embedded. “I went to the woods because I wished to live deliberately.” In order “to look again at the actual words of _Walden_, the main literary monument to the era’s eccentric etymological speculation” (Michael West), “deliberately” is the best place to start. This article aims to subject Walden’s most notable (instance of the) adverb to Thoreau’s hermeneutic methodology, “laboriously seeking [its] meaning” and minding the “perpetual suggestions and provocations” of etymology. In other words, it is an attempt to read the word (...) as deliberately as he, a Harvard-trained translator of the Classics and connoisseur of Enlightenment and Romantic philological theories, wrote it. This article focuses on wordplay stemming from the pseudo-etymological root “_liber_”—from freedom, through bark and leaves, to books. Throughout, the multi-layered ad-verb is shown to illustrate Thoreau’s idiosyncratic conception of ancient _askesis_. (shrink)

Unul dintre cele mai importante subiecte de dezbatere în contextul deliberărilor publice privind revizuirea Constituției a fost lansat, fără îndoială, de solicitările de revizuire a ei in sens creștin. Solicitările în discuție au fost făcute, după cum este cunoscut, de Sinodul mitropolitan al Mitropoliei Moldovei și Bucovinei în 5 martie 2013. Potrivit acestor solicitări, ar fi dezirabil ca, printre altele, noua Constituție „să facă referire la numele lui Dumnezeu”, să „sublinieze ... importanța tradiției creștine a poporului român”, să evidențieze „rolul (...) pe care Biserica Ortodoxă Română l-a avut și îl are în istoria țării” și – nu în ultimul rând – să recunoască „necesitatea predării religiei în școală.” In acest articol, explorez, în limitele spațiului pe care îl am la dispoziție, fiecare dintre aceste solicitări. Obiectivul meu fundamental este acela de a arăta că – și de a explica de ce – niciuna dintre ele nu este o solicitare „rezonabilă”. Prin aceasta înțeleg că niciuna dintre solicitările Sinodului mitropolitan al Mitropoliei Moldovei și Bucovinei nu este suficient susținută argumentativ și – mai ales – că niciuna dintre ele nu este compatibilă cu idealul unei societăți organizate și guvernate în baza unor valori precum libertatea, egalitatea și echitatea în relațiile dintre cetățeni. Ceea ce sper să arăt este, cu alte cuvinte, că, dat fiind respectul pe care îl datorăm acestor valori, România trebuie să rămână și în viitor un stat laic sau, poate mai corect spus, unul neutru din punct de vedere religios, așa cum statuează în prezent articolul 9 al Legii nr. 489/2006 privind libertatea religioasă și regimul general al cultelor. Articolul precizează, reamintesc, că în România „nu există religie de stat” și că „statul este neutru față de orice credință religioasă sau ideologie atee”. (shrink)

Moorean arguments are a popular and powerful way to engage highly revisionary philosophical views, such as nihilism about motion, time, truth, consciousness, causation, and various kinds of skepticism (e.g., external world, other minds, inductive, global). They take, as a premise, a highly plausible first-order claim (e.g., cars move, I ate breakfast before lunch, it’s true that some fish have gills) and conclude from it the falsity of the highly revisionary philosophical thesis. Moorean arguments can be used against nihilists in ethics (...) (error theorists), too. Recently, error theorists have recognized Moorean arguments as a powerful challenge and have tried to meet it. They’ve argued that moral Moorean premises seem highly credible to us, but aren’t, by offering various debunking explanations. These explanations all appeal to higher-order evidence—evidence of error in our reasoning. I argue that drawing attention to higher-order evidence is a welcome contribution from error theorists, but that the higher-order evidence actually counts further against error theoretic arguments—including their debunking explanations—and further in favor of Moorean arguments and the commonsense views they support. Along the way I answer a few prominent objections to Moorean arguments: that they are objectionably question-begging, rely on categorizing some facts as “Moorean Facts”, and that reports of one’s credence in a proposition bears no interesting relation to that proposition’s credibility. A tradição filosófica das abordagens da moral tem predominantemente como base conceitos e teorias metafísicas e teológicas. Entre os conceitos tradicionais de ética, o mais proeminente é a Teoria do Comando Divino (TCD). De acordo com a TCD, Deus dá fundamentos morais à humanidade desde sua criação e por meio de revelações. Assim, moralidade e divindade seriam inseparáveis desde a civilização mais remota. Esses conceitos submergem em uma estrutura teológica e são principalmente aceitos pela maioria dos seguidores das três tradições (...) Abraâmicas: judaísmo, cristianismo e islamismo, abrangendo a parte mais considerável da população humana. Mantendo a fé e a Revelação como seus fundamentos, as Teorias do Comando Divino não estão estritamente sujeitas a qualquer tipo de demonstração. Os oponentes da concepção moral do Comando Divino, fundamentados na impossibilidade de demonstrar suas suposições metafísicas e religiosas, tentam há muitos séculos (embora sem sucesso) desvalorizar sua importância. Eles sustentam o argumento de que a teoria não mostra evidências materiais e coerência lógica e, por esse motivo, não pode ser levada em consideração para fins científicos ou filosóficos. É apenas uma crença e, como tal, deve ser entendida. Além dessas oposições extremas, muitos outros conceitos atacam as teorias do Comando Divino, de uma ou de outra maneira, em parte ou na totalidade. Muitos filósofos e cientistas sociais, da clássica filosofia grega até a presente data, por exemplo, sustentam que a moralidade é apenas uma construção e, portanto, culturalmente relativa e culturalmente determinada. No entanto, isso traz muitas outras discussões e impõe o desafio de determinar qual é o significado da cultura, quais elementos da cultura são moralmente determinantes e, finalmente, quais são os limites dessa relatividade. Os deterministas morais, por sua vez, afirmam que tudo relacionado ao comportamento humano, incluindo a moralidade, é determinado em suas causas, uma vez que o livre-arbítrio não existe. Mais recentemente, os pensadores modernos argumentaram que existe uma rigorosa ciência da moralidade. No entanto, o método científico por si só, apesar de explicar vários fatos e evidências, não pode esclarecer todo o conteúdo e todo o significado da ética. A compreensão moral exige uma percepção mais ampla e um acordo entre os filósofos, que eles nunca alcançaram. Todas essas perguntas têm muitas configurações diferentes, dependendo de cada linha filosófica, e iniciam análises complexas e debates intermináveis, uma vez que muitas delas são reciprocamente conflitantes. O universo e a atmosfera envolvendo esta estudo são os domínios de todos esses conflitos conceptuais, observados de um ponto de vista objetivo e evolutivo. Independentemente dessa circunstância e de sua importância intrínseca, essas questões estão muito distantes da abordagem metodológica de uma discussão analítica sobre a moral objetiva, a qual é, de fato, o objetivo e o escopo deste trabalho. Devemos revisitar brevemente essas importantes teorias tradicionais, porque esta pesquisa abriga um estudo comparativo, e suas suposições pelo menos diferem profundamente de todas as teorias tradicionais. Portanto, torna-se necessário oferecer ao leitor, neste texto, elementos diretos e específicos de comparação para críticas válidas, dispensando pesquisas interruptivas. No entanto, mesmo revisitando as teorias tradicionais, para esse objetivo de exposição comparativa e crítica, elas serão mantidas ao lado de nossas principais preocupações, como " aliena materia ". Independentemente da validade de qualquer um ou de todos os elementos dessa discussão e de seu significado como universo filosófico deste trabalho, o objetivo do nosso estudo é demonstrar e justificar a existência e o significado de arquétipos morais pré-históricos surgidos diretamente dos princípios fundamentais, necessidades sociais e esforços para a sobrevivência. Esses arquétipos são a definição do fundamento essencial da ética, sua agregação ao inconsciente coletivo e organização lógica correspondente e transmissão aos estágios evolutivos do genoma humano e às diferentes relações espaço-tempo, independentemente de qualquer experiência contemporânea dos indivíduos. O sistema definido por esses arquétipos compõe um modelo social humano evolutivo. Esta é uma posição metaética? Sim, ela é. Além disso, como em qualquer raciocínio metaético, devemos procurar cuidadosamente as melhores e coerentes rotas, como a Filosofia Analítica lhes oferece. Desta forma, este trabalho deve demonstrar razoavelmente que a moral não é um produto cultural dos homens civilizados ou das sociedades modernas e que, apesar de estar sujeito a várias agregações e subtrações culturais relativas, seus fundamentos essenciais são arquetípicos e nunca mudaram estruturalmente. Esse raciocínio induz que a moralidade é um atributo primal do "homo sapiens"; não é uma propriedade e nem um acidente: integra a essência humana e pertence ao reino da identidade ontológica humana. -/- O fenômeno humano é um processo contínuo, desempenhando seu papel entre determinação aleatória e livre-arbítrio, e precisamos questionar como a moralidade começou e como chegou a nós no presente. [English] This paper aims to discuss ten traditional and contemporary methodological paradigms in African philosophy, and demonstrates how they may apply to African environmental ethics research. The methods include: Ethno-philosophy, Sage Philosophy, Conversational Philosophy, Conceptual Mandelanization, Eco-Afrocentricism, Indigenous Language Analysis, Eco-Afro-feminism, Conceptual Decolonization, Storytelling Philosophy, and Cultural Adaptationism. The significance and limitations of the methodologies are highlighted. The concept and principles of African environmental ethics are analyzed and discussed to facilitate an understanding of the conceptual frameworks that underpin the methodologies. (...) In this essay we collect and put together a number of ideas relevant to the under- standing of the phenomenon of creativity, confining our considerations mostly to the domain of cognitive psychology while we will, on a few occasions, hint at neuropsy- chological underpinnings as well. In this, we will mostly focus on creativity in science, since creativity in other domains of human endeavor have common links with scientific creativity while differing in numerous other specific respects. We begin by briefly (...) introducing a few basic notions relating to cognition, among which the notion of ‘concepts’ is of basic relevance. The myriads of concepts lodged in our mind constitute a ‘conceptual space’ of an enormously complex structure, where con- cepts are correlated by beliefs that are themselves made up of concepts and are as- sociated with emotions. The conceptual space, moreover, is perpetually in a state of dynamic evolution that is once again of a complex nature. A major component of the dynamic evolution is made up of incessant acts of inference, where an inference occurs essentially by means of a succession of correlations among concepts set up with beliefs and heuristics, the latter being beliefs of a special kind, namely, ones relatively free of emotional associations and possessed of a relatively greater degree of justification. Beliefs, along with heuristics, have been described as the ‘mind’s software’, and con- stitute important cognitive components of the self-linked psychological resources of an individual. The self is the psychological engine driving all our mental and physical activity, and is in a state of ceaseless dynamics resulting from one’s most intimate ex- periences of the world accumulating in the course of one’s journey through life. Many of our psychological resources are of a dual character, having both a self-linked and a shared character, the latter being held in common with larger groups of people and imbibed from cultural inputs. We focus on the privately held self-linked beliefs of an individual, since these are presumably of central relevance in making possible inductive inferences – ones in which there arises a fundamental need of adopting a choice or making a decision. Beliefs, decisions, and inferences, all have the common link to the self of an individual and, in this, are fundamentally analogous to free will, where all of these have an aspect of non-determinism inherent in them. Creativity involves a major restructuring of the conceptual space where a sustained inferential process eventually links remote conceptual domains, thereby opening up the possibility of a large number of new correlations between remote concepts by a cascading process. Since the process of inductive inference depends crucially on de- cisions at critical junctures of the inferential chain, it becomes necessary to examine the basic mechanism underlying the making of decisions. In the framework that we attempt to build up for the understanding of scientific creativity, this role of decision making in the inferential process assumes central relevance. With this background in place, we briefly sketch the affect theory of decisions. Affect is an innate system of response to perceptual inputs received either from the exter- nal world or from the internal physiological and psychological environment whereby a positive or negative valence gets associated with a perceptual input. Almost every sit- uation faced by an individual, even one experienced tacitly, i.e., without overt aware-ness, elicits an affective response from him, carrying a positive or negative valence that underlies all sorts of decision making, including ones carried out unconsciously in inferential processes. Referring to the process of inferential exploration of the conceptual space that gener- ates the possibility of correlations being established between remote conceptual do- mains, such exploration is guided and steered at every stage by the affect system, analogous to the way a complex computer program proceeds through junctures where the program ascertains whether specified conditions are met with by way of generating appropriate numerical values – for instance, the program takes different routes, depending on whether some particular numerical value turns out to be positive or negative. The valence generated by the affect system in the process of adoption of a choice plays a similar role which therefore is of crucial relevance in inferential processes, especially in the exploration of the conceptual space where remote domains need to be linked up – the affect system produces a response along a single value dimension, resembling a number with a sign and a magnitude. While the affect system plays a guiding role in the exploration of the conceptual space, the process of exploration itself consists of the establishment of correlations between concepts by means of beliefs and heuristics, the self-linked ones among the latter having a special role in making possible the inferential journey along alternative routes whenever the shared rules of inference become inadequate. A successful access to a remote conceptual domain, necessary for the creative solution of a standing problem or anomaly – one that could not be solved within the limited domain hitherto accessed – requires a phase of relatively slow cumulative search and then, at some stage, a rapid cascading process when a solution is in sight. Representing the conceptual space in the form of a complex network, the overall process can be likened to one of self-organized criticality commonly observed in the dynamical evolution of complex systems. In order that inferential access to remote domains may actually be possible, it is necessary that restrictions on the exploration process – necessary for setting the context in ordinary instances of inductive inference – be relaxed and a relatively free exploration in a larger conceptual terrain be made possible. This is achieved by the mind going into the default mode, where external constraints – ones imposed by shared beliefs and modes of exploration – are made inoperative. While explaining all these various aspects of the creative process, we underline the supremely important role that analogy plays in it. Broadly speaking, analogy is in the nature of a heuristic, establishing correlations between concepts. However, analo- gies are very special in that these are particularly effective in establishing correlations among remote concepts, since analogy works without regard to the contiguity of the concepts in the conceptual space. In establishing links between concepts, analogies have the power to light up entire terrains in the conceptual space when a rapid cas- cading of fresh correlations becomes possible. The creative process occurs within the mind of a single individual or of a few closely collaborating individuals, but is then continued by an entire epistemic community, eventually resulting in a conceptual revolution. Such conceptual revolutions make pos- sible the radical revision of scientific theories whereby the scope of an extant theory is broadened and a new theoretical framework makes its appearance. The emerging theory is characterized by a certain degree of incommensurability when compared with the earlier one – a feature that may appear strange at first sight. But incommen- surability does not mean incompatibility and the apparently contrary features of the relation between the successive theories may be traced to the multi-layered structureof the conceptual space where concepts are correlated not by means of single links but by multiple ones, thereby generating multiple layers of correlation, among which some are retained and some created afresh in a conceptual restructuring. We conclude with the observation that creativity occurs on all scales. Analogous to correlations being set up across domains in the conceptual space and new domains being generated, processes with similar features can occur within the confines of a domain where a new layer of inferential links may be generated, connecting up sub- domains. In this context, insight can be looked upon as an instance of creativity within the confines of a domain of a relatively limited extent. (shrink)

That is, could there be a property P that is instanti-ated at worlds w1 and w2, and is perfectly natural at w1 but not at w2? Here, we offer an original argument for the non-world-relativity of perfect naturalness. Despite many authors in psychiatry endorsing a naturalist view of the mind, many still consider that mental dysfunctions cannot be reduced to brain dysfunctions. This paper investigates the main reasons for this view. Some arguments rely on the analogy that the mind is like software while the brain is like hardware. The analogy suggests that just as software can malfunction independently of hardware malfunctions, similarly the mind can malfunction independently of any brain malfunction. This view has been critically examined in (...) recent literature. However, other less discussed reasons suggest that mental dysfunctions cannot be reduced to brain dysfunctions because mental dysfunctions are appropri- ately ascribed at the level of intentional mental states, while brain dysfunctions are solely related to abnormalities in anatomy and physiological processes. This paper questions why such a view would be upheld. The discussion is framed within the interface problem in the philosophy of cognitive science, which concerns the relationship between personal and subpersonal levels of explanation. The paper examines the view that an autonomist perspective on the personal/ subpersonal distinction could justify the separation of mental dysfunctions, described in intentional terms, from brain dysfunctions, described in anatomical or physiological terms. Ultimately, the paper argues that the autonomist view cannot be upheld in psychiatry and, consequently, does not provide a principled justification for rejecting the reduction of mental dysfunctions to brain dysfunctions. Desde Gintis é um economista sênior e eu li alguns de seus livros anteriores com interesse, eu estava esperando um pouco mais insights sobre o comportamento. Infelizmente, ele faz as mãos mortas de seleção de grupo e fenomenologia para as peças centrais de suas teorias de comportamento, e isso em grande parte invalida o trabalho. Pior, uma vez que ele mostra um julgamento tão ruim aqui, ele chama a questão de todo o seu trabalho anterior. A tentativa de ressuscitar a (...) seleção de grupos por seus amigos em Harvard, Nowak e Wilson, há alguns anos foi um dos maiores escândalos em biologia na última década, e eu tenho narrado a triste história no meu artigo ' altruísmo, Jesus e do fim do mundo-como o Templeton Foundation comprou uma cátedra de Harvard e atacou evolução, racionalidade e civilização-uma revisão de E.O. Wilson 'A Conquista social da Terra' (The Social Conquest of Earth) (2012) e Nowak e Highfield ' SuperCooperators ' (2012). Ao contrário de Nowak, Gintis não parece ser motivado pelo fanatismo religioso, mas pelo forte desejo de gerar uma alternativa para as realidades sombrias da natureza humana, facilitada pela (perto Universal) falta de compreensão da biologia humana e Blank Slateism (tábua rasa) de cientistas comportamentais, outros acadêmicos e o público em geral. Gintis justamente ataca (como ele tem muitas vezes antes) economistas, sociólogos e outros cientistas comportamentais por não ter um quadro coerente para descrever o comportamento. Naturalmente, a estrutura necessária para entender o comportamento é um evolucionário. Infelizmente, ele não consegue fornecer um próprio (de acordo com seus muitos críticos e eu concordo), e a tentativa de transplantar o cadáver podre de seleção de grupo para qualquer teorias econômicas e psicológicas que ele gerou em suas décadas de trabalho, meramente invalida todo o seu projeto. Embora Gintis faz um esforço valente para entender e explicar a genética, como Wilson e Nowak, ele está longe de ser um perito, e como eles, a matemática apenas o cega para as impossibilidades biológicas e, claro, esta é a norma na ciência. Como Wittgenstein famosa observou na primeira página de cultura e valor "não há nenhuma denominação religiosa em que o uso indevido de expressões metafísicas tem sido responsável por tanto pecado como tem em matemática." Sempre foi evidente que um gene que provoca comportamento que diminui a sua própria frequência não pode persistir, mas este é o cerne da noção de seleção de grupo. Além disso, tem sido bem conhecido e muitas vezes demonstrado que a seleção de grupo apenas reduz a aptidão inclusiva (seleção de parentes), que, como observou Dawkins, é apenas um outro nome para a evolução pela seleção natural. Como Wilson, Gintis tem trabalhado nesta arena por cerca de 50 anos e ainda não entendeu, mas depois que o escândalo quebrou, levei apenas 3 dias para encontrar, ler e entender o trabalho profissional mais relevante, como detalhado no meu artigo. É incompreensível para perceber que Gintis e Wilson foram incapazes de realizar isso em quase meio século. Discuto os erros de seleção de grupo e fenomenologia que são a norma na Academia como casos especiais da falha universal perto de entender a natureza humana que estão destruindo a América e o mundo. Peirce’s pragmatist theory of truth holds that truth will be the outcome of an indefinitely adequate amount of scientific research. According to the minima trivialia objection, Peirce’s theory of truth is refuted by such common sense truths as that about what I ate for breakfast, which is hardly the outcome of a prolonged collective scientific endeavour. The argument does not work, however, if we endorse Sellars’s distinction between the manifest image and the scientific image of mankind in the world and (...) the connected scientific realism: in this Sellarsian context, minima trivialia can be seen as false views from the perspective of the manifest image, like the existence and persistence of material objects, and not as proper truths, which are appreciated as such only from the point of view of the scientific image. Therefore, the endorsement of this distinction, which is quite compatible with Peirce’s framework, bypasses the minima trivialia objection. (shrink)

Desde os anos 1990, os efeitos da globalização na lei e nos desenvolvimento jurídico têm sido um tópico central no debate acadêmico. Até o presente, o debate foi, contudo, marcado por três lacunas que este capítulo tentará remediar a partir de uma reconceptualização do direito global como o direito de intercontextualidade marcado pela inter-juridicidade e materializado por meio de um corpo de normas que podem ser caracterizadas por sua conectividade. A primeira lacuna é de ordem histórica e empírica. Tanto os (...) críticos quanto os defensores da “lei não estatal” compartilham a premissa de que a “lei além do Estado” e as normas jurídicas correlatas teriam ganhado relevância nos tempos atuais se comparadas a períodos históricos anteriores. Enquanto o direito global, incluindo tanto o direito público e privado de governança global, bem como as construções regionais, como da União Europeia, passou por profundas transformações desde as estruturais, que seguiram os processos de descolonização em meados do século XX, constata-se que não há mais instrumentos de direito global em comparação com outros tipos de lei no mundo contemporâneo do que havia em outros períodos históricos. A segunda lacuna é metodológica. A maioria das produções acadêmicas sobre o direito global é ou de natureza analítica, trazendo reflexões a partir do campo da filosofia, ou de natureza empírica, observando a existência do direito global e os graus de conformidade às normas global em um dado período histórico. Embora essas duas metodologias tenham seu mérito, elas são estáticas, incapazes de explicar e de avaliar a transformação do direito global ao longo do tempo. A terceira lacuna é teórico-conceitual. Em diversas instâncias, o direito global é compreendido como uma lei unitária que produz normas de escala planetária, ou, alternativamente, adota-se uma perspectiva pluralista radical que descarta a existência de normas globais singulares. No entanto, ambas as abordagens parecem não compreender as características estruturais, função e efeitos societários do direito global. Ao contrário, uma terceira posição entre as perspectivas unitárias e radicais pode ser adotada por meio de uma compreensão do direito global e normas legais relacionadas como um tipo descentralizado de direito intercontextual e caracterizado pela inter juridicidade. O direito global pode ser definido como um fenômeno que, a princípio, é ilimitado em alcance, isto é, detém validade sem referência ou limitação a um território ou população específica, embora, por razões práticas, seja submetido a alguma limitação na maioria dos casos. Isso torna o direito global distinto do direito nacional, internacional, transnacional e da lei viva de base comunitária quando definidos da seguinte maneira: direito nacional, a lei dos estados-nação derivada do conceito de soberania; o direito internacional, a lei entre estados-nação; direito transnacional, qualquer lei que, em termos de jurisdição, origem ou efeito, ultrapassa as fronteiras nacionais, produzindo externalidades positivas ou negativas, enquanto continua a depender dos instrumentos e mecanismos legais dos estados; lei viva, normas sociais preenchendo a função de lei no seio de uma comunidade. Esses quatro tipos de lei podem agir, potencialmente, como fonte do direito global inter-jurídico na medida em que são empregadas numa forma intercontextual. Refletindo essa estrutura inter-jurídica, o conteúdo normativo substancial do direito global é caracterizado por uma relativa predominância estrutural de normas de conectividade. Normas de conectividade estão orientadas a facilitar o transplante, isso é, a extração, transmissão e incorporação dos componentes de significado de um contexto jurídico-legal para outro, como, por exemplo, no caso do comércio internacional e das leis de investimento, lei comercial doméstica ou leis aprovadas sobre atividades missionárias no contexto das leis religiosas. O conceito de normas de conectividade, portanto, diferencia-se do entendimento clássico sobre as normas de coerência, cuja finalidade é dar coerência no âmbito de uma coletividade sob a base de prescrições de ações que limitem o escopo de possíveis ações futuras e estabelecer sanções para a não-conformidade. Diferencia-se, ainda, de um entendimento progressivo sobre as normas como normas de possibilidade, implicando a articulação de futuros possíveis com base numa distinção entre o factual e o não-factual, isto é, mediante o distanciamento do mundo factual, com o objetivo de acentuar a abertura do futuro. Assim sendo, as normas de conectividade são, em outras palavras, um terceiro tipo de normas localizado entre as normas de coerência e as normas de possibilidade. (shrink)

Does a coherentist version of rationality issue requirements on states? Or does it issue requirements on processes? This paper evalu- ates the possibility of process-requirements. It argues that there are two possible definitions of state- and process-requirements: a satisfaction- based definition and a content-based definition. I demonstrate that the satisfaction-based definition is inappropriate. It does not allow us to uphold a clear-cut distinction between state- and process-requirements. We should therefore use a content-based definition of state- and pro- cess-requirements. However, a (...) content-based definition entails that ra- tionality does not issue process-requirements. Content-based process- requirements violate the principle that ‘rationality requires’ implies ‘can satisfy’. The conclusion of this paper therefore amounts to a radical re- jection of process-requirements of rationality. (shrink)

No capítulo 1, “Do escudo de Aquiles à capa do Batman: o heroísmo togado e seus riscos à democracia”, discutimos a ascensão do protagonismo político no Poder Judiciário a partir da categoria antropológica do herói, expondo a delicada relação entre heroísmo e instituições democráticas. Para isso, traçamos um breve histórico do heroísmo e suas características, apresentando, posteriormente, uma analogia entre elas e a atuação do Ministro Joaquim Barbosa no curso da Ação Penal nº 470 do STF (Caso Mensalão). Tecemos também (...) alguns apontamentos sobre o Estado Democrático de Direito, a função do Poder Judiciário e os riscos que a propagação de escândalos públicos e a flexibilização de regras e princípios jurídicos podem trazer às instituições do Estado Democrático de Direito. O tema de fundo dessa análise é a relação simbiótica entre a violência e a produção mítica de heróis, segundo a teoria de Girard. No capítulo 2, “Satã: a violência na fundação da cultura”, analisamos a obra “Vejo Satã cair como um relâmpago”, de René Girard, apresentando sua teoria (mimética) e seu estudo antropológico da Bíblia e dos Evangelhos. O intuito é demonstrar a possibilidade de interpretar racionalmente dados antes percebidos como sobrenaturais, explorando, com Girard, as contribuições da revelação judaico-cristãs para a relação entre o homem, a violência e a organização político-religiosa do mundo antigo. O principal tema exposto na resenha é o da violência fundadora, base da cultura e da sociedade, que Girard identifica na figura bíblica de Satã. Mais do que mero símbolo religioso, Satã é a representação de um mecanismo de pacificação deflagrado em situações de crise social. Seu modus operandi consiste na reunião da sociedade contra um inimigo comum, um bode expiatório contra o qual levantam-se falsas acusações que sustentam sua perseguição e assassinato. Consideramos esse tema fundamental para a moderna e contemporânea compreensão dos processos de perseguição e vitimização político-social. A revelação cristã é a entrada em cena, no campo histórico, de um pensamento que se coloca francamente ao lado da vítima acusada pela comunidade. As ideologias penais da proteção do débil, os direitos individuais e os direitos humanos são efeitos políticos e jurídico do triunfo da cruz sobre a cultura satânica do assassínio de bodes expiatórios. No capítulo 3, “A violência no Direito: confissão e produção de bodes expiatórios”, aplicamos a teoria mimética para compreender o instituto jurídico da confissão do ponto de vista antropológico. Com base no Livro de Jó, investigamos a origem religiosa da extração forçada de confissões e demonstramos sua íntima relação com os rituais religiosos praticados na antiguidade, que usavam da assunção de culpa como um instrumento para legitimar a violência contra seus bodes expiatórios. Com isso, pretendemos apontar para a necessidade de mitigação do valor probatório da assunção de culpa no contexto de um Estado Democrático de Direito. Incorporada às intuições jurídicas, a confissão deve ser tomada como instrumento laico e totalmente desvinculado das práticas expiatórias que lhe deram origem. No capítulo 4, “Direito penal e preocupação pelas vítimas: a renovação dos princípios de ofensividade e proteção de bens jurídicos após a experiência do totalitarismo", analisamos o surgimento e desenvolvimento da ideia de crime como ofensa a bens jurídicos. Trata-se de um ensaio de história das ideias jurídicas em que traçamos a evolução histórica das ideias de ofensividade e proteção de bens jurídicos, desde sua gênese na experiência liberal e iluminista, passando por seu enfraquecimento durante o Direito Penal nacional-socialista, até culminar em seu ressurgimento e renovação nos dias atuais. O intuito desta análise é situar o princípio da ofensividade, enquanto garantia assegurada nas Constituições do Pós-guerra, no quadro histórico da moderna preocupação pelas vítimas, efeito cultural da religião cristã que discutimos no capítulo 2 (“Satã: a violência na fundação da cultura”). Por fim, no quinto e último capítulo, “O Direito após a revelação do mecanismo vitimário”, procuramos rematar a temática do Direito no quadro da antropologia de Girard, explorando o papel desempenhado pela revelação cristã do mecanismo expiatório na cultura ocidental, especialmente no que diz respeito à formação de uma ética de proteção das vítimas, eixo fundamental dos Direitos Humanos. Por isso, demonstramos como o Direito Penal, no ocidente, está dividido entre o sacrifício e o perdão. Resultado da lógica do cristianismo sacrificial, o moderno Direito constitui-se na forma híbrida de um Katéchon: ou seja, como racionalização do mecanismo vitimário, re-direcionado, por meio das instituições jurídicas e políticas, contra atos de perseguição de minorias e vulneráveis . Esta investigação tem por objetivo geral promover uma exposição do estado da arte do conceito de dolo eventual na dogmática penal, e, como objetivo específico, estabelecer bases metodológicas de como esse conceito pode ser construído, sistematizado e delimitado em relação à culpa consciente. A delimitação dos conceitos jurídico-penais é um importante instrumento para o estabelecimento de limites ao exercício do poder punitivo estatal. O conceito de dolo, na medida em que autoriza a aplicação de penas mais rigorosas em comparação à (...) culpa, demanda que a dogmática estabeleça claramente seus limites. Tarefa necessária não apenas para o conceito geral de dolo, mas também para o controverso “dolo eventual”, figura jurídica cuja conceituação e aplicação tem propiciado intensos debates na doutrina especializada, que, há pelo menos 200 anos, discute o problema de sua distinção com relação à outra figura não menos debatida, a da culpa (consciente). Devido à dificuldade de sua resolução, o pai do finalismo, Hans Welzel, considerou a distinção entre dolo eventual e culpa consciente uma das questões mais tormentosas do direito penal. Visando contribuir para o esclarecimento do tema, esta investigação apresenta dialeticamente os principais critérios e argumentos formulados na resolução desse intrincado problema jurídico, abrangendo, para este fim, tanto a discussão do período clássico da dogmática alemã (que legou vários conceitos até hoje debatidos e usados nesta matéria) quanto da moderna dogmática jurídico-penal, que tenta, a partir de novas abordagens, resolver a “tormentosa” questão.
